In the heart of Tampa Heights, our ministry encountered what can only be described as a heartbreaking scene of generational memory and family heritage left to rot. The condition of the property marked by piles of deteriorating documents, destroyed furniture, mold-threatening debris, and signs of long-term neglect is a testament to abandonment, not stewardship.
Florida Statutes § 386.01 defines a sanitary nuisance as any act or condition that threatens or impairs health, such as neglected property, improperly treated waste, or the breeding of disease-carrying insects.
It grants county health and code enforcement authorities the power to act on such nuisances, and allows for the potential intervention of non-governmental organizations (NGOs) when a public health hazard is severe. This statute serves as the legal basis for addressing conditions that are unsanitary, putrid, or neglected, deeming them public health hazards.
Under Florida Statutes § 705.101, property is deemed abandoned when it no longer carries intrinsic value to the presumed owner and is left without proper care or contact. That threshold has clearly been met.
Our presence is not trespass; it is testimony. It is peacekeeping. It is restoration. We took upon ourselves the moral and lawful duty to intervene, not for profit, but for preservation to shield what remained of family history, remnants of diaries, and sacred writings from becoming landfill.
We invoke protections under Florida law, doctrines of abandonment, the moral expectations of property stewardship, and most importantly, our constitutional and statutory rights under the Religious Land Use and Institutionalized Persons Act (RLUIPA).
This act of stewardship is both faith-based and lawful.
Saved By The Streets Ministry has done what others failed to do: preserve dignity, restore order, and protect sacred memory from decay.
